A MT Rowan woman accused of being the getaway driver in a Sebastopol armed robbery will face a third jury in the County Court at Ballarat.
Judge Barton Stott aborted Belinda Jayne Clark's second trial yesterday after her defence lawyer submitted that the Crown's closing address was prejudicial.
It was the second jury to be discharged without verdict in the trial of Clark.
Last Wednesday, a jury of eight women and four men was discharged within hours of being sworn in.
Judge Stott yesterday told the jury it may have been left with "prejudicial views" after Crown prosecutor David Cordy's closing address.
Judge Stott said he did not believe the problem could be "cured" by anything he could say and had no other option than to abort the trial.
"Sometimes counsel either deliberately or inadvertently say something which is not a correct comment of the law or which might be a prejudicial comment," he said.
"...Appropriately, I propose to discharge you now without verdict."
Clark, 39, has pleaded not guilty to one count of armed robbery.
It is alleged Ms Clark was the getaway driver in the armed robbery of the Sebastopol Pharmacy on August 19, last year.
Her former boyfriend, Daniel Wayne Pring, pleaded guilty to the crime in June and has given sworn evidence against Ms Clark.
The mother-of-two claims she drove Pring to the Bi-Lo supermarket in Sebastopol to get some coffee and had no knowledge of the hold-up.
But Crown prosecutor David Cordy yesterday described Ms Clark's explanation as "bunkum".
"She's like a rat caught in a trap and she's trying to extricate herself," he said.
Mr Cordy told the jury it had heard evidence of how the accused had used OxyContin - the drugs stolen in the hold-up - in April, 2003, and had lied to police upon her arrest.
The jury had also heard evidence of how Ms Clark's purse and tobacco were found near the imitation pistol used in the robbery, Mr Cordy said.
"What the prosecution says is that it's established beyond any shred of a doubt that she (Ms Clark) was involved," he said.
Ms Clark's third trial will be heard in the County Court at Ballarat at a later date.
