Hume 235km/h speedster escapes jail

A CANBERRA man caught driving at 235km/h on the Hume Highway in May yesterday had a four-month jail term reduced to community service in an appeal before a District Court judge.

John David Large, 31, of Chisholm, had the jail sentence and a four-year driving ban imposed by magistrate Gordon Lerve in Albury Local Court on August 5.

Mr Lerve described Large as having “a continuing attitude of irresponsibility on the roads” when imposing the penalties on a charge of driving at a dangerous speed.

But Judge Stephen Walmsley said in the District Court at Albury that there were alternative, more appropriate terms of punishment for the offence.

Judge Walmsley described the offence as “significant” but said he was persuaded to reduce the penalty to 100 hours community service and a two-year driving ban.

The Director of Public Prosecutions representative, Josephine Park, declined to make any submissions on the penalty and disqualification suggested by Judge Walmsley.

Large was driving his high-performance six-litre V8 Holden HSV utility with registration plates OFFTAP when checked on police radar near Holbrook about 1.30pm on May 7.

He was making his way to Melbourne for a family 60th birthday party and when stopped by police who asked about his excessive speed, he said: “I know, I know. You wouldn’t believe it.

“I was sitting on 115km/h all the way. I saw a straight stretch of road and thought I would give it a blat.”

Barrister Alan Blackman said yesterday the driving by Large lacked many of the aggravating features often seen with such offences.

There was nothing to suggest any erratic driving or passing of other vehicles.

Mr Blackman said Large had been assessed as suitable for community service and it could be transferred and registered in the ACT.
