CONVICTED drug dealer and gun seller Clinton Roy Parkinson faces the possibility of a longer jail sentence with an appeal against the inadequacy of a sentence imposed on him recently.
The NSW Director of Public Prosecutions, Nicholas Cowdrey QC, has lodged an appeal on the sentence given to Parkinson in the District Court at Albury.
Parkinson, described as the methylamphetamine “kingpin” of Albury, was jailed last month for a maximum of seven years by Judge Helen Murrell.
He received a minimum term of three years and nine months, but given time already spent in custody his earliest release date is June 16, 2012.
The leniency of the sentence surprised police and legal representatives involved in the case, considering Parkinson was facing a maximum of 20 years each on the gun and drugs charges.
The appeal by the DPP will be heard in the NSW Court of Criminal Appeal and is listed for mention early next month.
Senior legal practitioners believe that Parkinson’s minimum term could almost double considering previous guideline judgements handed down by the Court of Criminal Appeal in both drugs and guns offences.
Parkinson, 26, was busted in dramatic circumstances in the Harvey Norman shopping centre car park in September last year after a three-month undercover police operation.
The Albury drug squad unit began Operation Roll on May 7 to target his drug involvement and some of his associates.
It became a joint taskforce between state crime command, the drug squad and Albury unit.
There were 10 controlled purchases by a police operative between June 18 and September.
Parkinson was paid amounts varying from $1750 to $6500 for drugs and guns, receiving a total of $39,850.
The drugs were supplied by Parkinson from his home and other locations, including Holbrook, where he met the operative.
The operative paid $3000 for the .22 pistol and made a forward payment of the same amount for the second pistol.
The drugs, after being supplied by Parkinson, were weighed and analysed for purity, which ranged from 7 per cent to 2 per cent.
