A LAVINGTON woman, 28, three months’ pregnant with her 10th child was yesterday jailed for six months on driving offences.

Kylie Michelle Waite sat crying in the dock in the District Court at
Albury before being taken into custody after an unsuccessful severity appeal against penalties imposed by magistrate Tony Murray in June.
Waite, who has the care of four children aged under five, could have her 10th child in jail with her earliest release date March 4 next year.
Judge David Freeman said Waite, who has never held a driver’s licence, had “an inability or unwillingness to comply with the law”.
“The number of times she has been dealt with for disqualified driving and being unlicensed is staggering considering her age,” he said.
Judge Freeman said he was
always loath to send someone to jail, particularly young women and young mothers.
“But there comes a time when there is no alternative,” he said.
Director of Public Prosecutions representative Tonya Adamson said it may sound a little callous but Waite should have been thinking about her children when she got behind the wheel.
Waite’s de facto is likewise a disqualified driver and solicitor David Pheeney said the vehicle has been sold.
Mr Murray was told Waite, of Wagga Road, was caught driving when disqualified five times since January.
The offences were on January 28, February 17 and 23, April 27 and June 19.
She pleaded not guilty to the offence in April and it is listed for Albury Local Court next week, but entered guilty pleas to the other four charges.
Waite received a six-month jail term and Mr Murray extended her driving ban from April 27 next year by another eight years.
Mr Pheeney said Waite was caring for four children aged five, three, two and nine months.
He said Waite’s father was a violent alcoholic who perpetrated domestic violence, she completed year 10 at school and had her first child at 17.
Mr Pheeney made a submission seeking a suspended sentencing saying Waite knew she was “at the crossroads in her life”.
She has never been in jail, but spent three days in custody waiting for appeal bail.
Ms Adamson said Waite has shown a continuing disregard for driving laws after briefly having a learner’s permit in 1999.
Judge Freeman confirmed the penalties imposed by Mr Murray.
