Mum, 28, may have 10th baby in jail

A LAVINGTON woman, 28, three months’ pregnant with her 10th child was yesterday jailed for six months on driving offences.

Kylie Michelle Waite sat crying in the dock in the District Court at

Albury before being taken into custody after an unsuccessful severity appeal against penalties imposed by magistrate Tony Murray in June.

Waite, who has the care of four children aged under five, could have her 10th child in jail with her earliest release date March 4 next year.

Judge David Freeman said Waite, who has never held a driver’s licence, had “an inability or unwillingness to comply with the law”.

“The number of times she has been dealt with for disqualified driving and being unlicensed is staggering considering her age,” he said.

Judge Freeman said he was

always loath to send someone to jail, particularly young women and young mothers.

“But there comes a time when there is no alternative,” he said.

Director of Public Prosecutions representative Tonya Adamson said it may sound a little callous but Waite should have been thinking about her children when she got behind the wheel.

Waite’s de facto is likewise a disqualified driver and solicitor David Pheeney said the vehicle has been sold.

Mr Murray was told Waite, of Wagga Road, was caught driving when disqualified five times since January.

The offences were on January 28, February 17 and 23, April 27 and June 19.

She pleaded not guilty to the offence in April and it is listed for Albury Local Court next week, but entered guilty pleas to the other four charges.

Waite received a six-month jail term and Mr Murray extended her driving ban from April 27 next year by another eight years.

Mr Pheeney said Waite was caring for four children aged five, three, two and nine months.

He said Waite’s father was a violent alcoholic who perpetrated domestic violence, she completed year 10 at school and had her first child at 17.

Mr Pheeney made a submission seeking a suspended sentencing saying Waite knew she was “at the crossroads in her life”.

She has never been in jail, but spent three days in custody waiting for appeal bail.

Ms Adamson said Waite has shown a continuing disregard for driving laws after briefly having a learner’s permit in 1999.

Judge Freeman confirmed the penalties imposed by Mr Murray.

Finally, Kylie serves time. She has only been sentenced for driving on 4 occasions. What about the other 361? I can tell you she drove a car every day of her life! Well done to the Magistrate.

Seriously, they say she has “an inability or unwillingness to comply with the law”. Well, if instead of continuing to ban her driving priveledges, and maybe put her in a program, and sent her to Driving School, and allowed her to get her license, she would no longer have an inabilty. Maybe? Idiots

And if your not kidding, who pays for this? I nominate you, since you seem to think a person who can't operate a condom should drive tonnes of metal down the street. If you think it's a good idea, why don't you go give her driving lessons. Maybe after the seventh time you asked her to perform a simple driving task and she does exactly the opposite because "she knows what she's doing" you'll understand that some people just don't do what their told. It's a wonder she hasn't hurt or killed anybody yet. All I have to say about your comment is REALLY?

Why should young women get a break over young men? Why should women be rewarded even more for having a kid--don't young fathers deserve equality under the law? Justice is supposed to be fair and blind. This judge freely admits he does not follow that principle. When rewarding people for bad behavior, you can't act surprised when they do it. That applies to drinking and driving mothers, judges that aren't removed from the bench, or men who don't protest this unfair and unequal treatment.

This shows how the system contains no hint of common sense- it's seriously approaching Nanny State level. How is a mother of so many children expected to perform common necessary duties without the ability to drive legally? You can give excuses like public transportation or rides from others- but as a 25 year old without a car I can tell you that it's VERY difficult, & I don't even have children! Poor woman. I understand concequences for repeat disreguard of the law, but like the above comment said, sounds like the court missed an opportunity to think outside the box & actually create a viable solution to the situation. Suspend her licence another 8 years? Idiots.
