Magistrate's 'dog excrement threat'

Victorian Magistrate Raffaele Barberio failed to appear in court to face assault charges today because of a medical condition.

Barberio was expected to appear at the Moorabbin Magistrates Court this morning in Melbourne for a first mention on numerous charges including assault, but his lawyer, Peter Ward, said his client had a health issue and a cardiologist had submitted a report to the court.

Chief Magistrate Ian Gray said he accepted the report and extended Barberio's bail until February 5 when he is next scheduled to appear in court.

Barberio, 60, a long-serving magistrate, is facing two sets of criminal charges from alleged incidents in March and October.

The charges include unlawful assault, damaging property, stalking and harassment.

One of the unlawful assault counts relates to an allegation Barberio threatened to throw dog excrement at a person who cannot be identified for legal reasons.

Mr Gray also extended an intervention order against Barberio.

Outside court, Mr Ward said he could not comment further on Barberio's health.
