Jean Cook’s case was due to go before a Victorian Civil and Administrative Tribunal hearing in Wangaratta this week.
But just before it was due to start, the tribunal received a faxed letter from the real estate agent to say the matter had been settled.
Mrs Cook decided earlier this year to take her case to the tribunal to stop her eviction from her High Street unit of six years.
The stress of her predicament was magnified by her diabetes and pulmonary fibrosis, the latter reducing her lung capacity by a third.
Mrs Cook had wanted to move to Gundaroo, near Canberra, and her son emailed Beechworth Real Estate in mid-December, giving notice of her intention to move out.
But after visiting the town she realised the medical facilities were inadequate.
A week after the email was sent, Ash Cook told the agency she wanted to stay but new tenants had already been organised.
