POLICE say they don’t have enough evidence to lay criminal charges against the mother and babysitter blamed for the death of Myrtleford toddler Daniel Thomas.

Victoria Police conducted a fresh investigation into Daniel's death last year after the coroner found he died because his babysitter, Mandy Martyn, had abused him and his mother, Donna Thomas, had failed to protect him.
Coroner Jacinta Heffey last July ruled Daniel died in October 2003 because he was abused by Ms Martyn and not protected by Ms Thomas.
In November police submitted a brief of evidence to the Office of Public Prosecutions but the OPP has advised they do not think there is sufficient evidence to proceed.
The investigation remains open.
