Since 2008 the composting plant has been the subject of complaints from nearby housing estates at Killara that were built after the plant was established.
Wodonga councillors decided in 2012 to look at options to withdraw Greenchip’s planning permit, and lodged proceedings with VCAT in 2013 that are ongoing.
Greenchip Recycling won its most recent case in March, after it sought to build a new shed in which to turn compost into pellet fertiliser and three silos in which to store the pellets.
While the council had initially refused to accept an application from Mr Corrigan on the basis he had to pay an additional fee, VCAT sided with Greenchip and ruled against the council in allowing the pelletising.
VCAT also found the pellet end products would potentially reduce the odour risk on site.
This is a battle likely to remain before VCAT for some time to come.
