“I would think the sentence was bordering on lenient,” Judge Gordon Lerve said.

Todd Killender, 31, had lodged a severity appeal against the jail sentence imposed by magistrate Tony Murray at Corowa Local Court on April 15.

Killender had only been released last November after serving eight months in Victoria for assaulting police.

But tendered police facts indicate he went to the Corowa Hotel in Sanger Street about 12.05am on January 1.

He was refused entry due to his level of intoxication and argued about the issue.

When he continued to argue, the police were called and while waiting for them he was escorted away from the hotel.

Killender argued with police, became aggressive, tore his shirt off and shaped up to officers.

He was informed he was under arrest, but attempted to walk away.

Police used a short burst of capsicum spray to subdue him and he was later decontaminated by ambulance officers.

Killender represented himself in yesterday’s appeal and conceded his extensive Victorian record.

“I have spent a lot of time in jail,” he said.
