Victorian minors can send explicit photographs of themselves, but not other children, while it is illegal to send those photographs of anyone underage in NSW.
Hume Riverina Community Legal Service has highlighted the anomaly as part of its submission to the Victorian Government’s access to justice inquiry.
“Sexting between states, such as from Wodonga to Albury, can result in offences being committed and charges being laid in both states,” the submission stated.
Hume Riverina CLS recommended the government allocate more funding to legal centres to provide early advice to clients.
It also stated Dispute Settlement Centre of Victoria services should be extended to regional Victoria, where people were missing out on advice in family property and intervention order disputes.
