The ear, nose and throat specialist had a ban lifted on Monday after a hearing in the NSW Civil and Administrative Tribunal following a complaint to the NSW Medical Council.

The council had suspended Dr von Marburg in May.

In a statement, Dr von Marburg said the complaint was not related to his clinical care.

“The council acted with haste to suspend me,” he said.

“Their decision was appealed and it is satisfied that the suspension can be lifted and have reversed their previous decision.

“The complaint was unsubstantiated, largely false and I will explore all reasonable avenues against those involved.”

Dr von Marburg did not wish to be more specific about the complaint, because of concerns he may breach confidentiality rules governing hearings.

However, he said “reasonable avenues” may involve a complaint to police or a legal remedy.

The case against Dr von Marburg has links to his support for pro-life protests outside Albury’s abortion clinic.

In his statement, the Kiewa Street medico said: “Sadly, there has been an orchestrated campaign of character assassination against me led by a small group of political activists.

“They have fuelled an opportunistic lynch mob.

“Both the MCNSW and NCAT have described the environment created by this group, which includes some local doctors, as ‘toxic’.

“For the benefit of our local community they should reconsider their actions.”

Dr von Marburg said his rooms would reopen on Tuesday with consultations to resume on Wednesday.

He said two of his five staff had taken other jobs during his suspension.

“I am deeply thankful to my family, friends, patients and staff for their prayers and commitment in extremely trying circumstances,” Dr von Marburg said.

“I am delighted to return to the full time care of our patients and look forward to providing quality clinical ear nose and throat services.”

The NSW Medical Council told The Border Mail it would respond to Dr von Marburg on Tuesday.
