Tony William Robinson, who is on bail over the allegation, fronted Albury Local Court this week to answer the matter.
Defence solicitor Melanie Lim said she hoped the brief of evidence might be supplied to her office before the day was out.
But magistrate Chris McRobert was not so confident, saying: “Yes, I believe in the tooth fairy too, Miss Lim. It’s not going to happen.”
Police have alleged that Robinson, 44, “manipulated his penis” outside his pants at Melrose Park on June 11. Robinson is charged with committing an act of indecency towards children aged 13, nine, five and 16 months.
His case will be mentioned again on August 28, though Robinson is not required to attend.
