Dawn Endresz, whose son Allan is the front man for a stoush with the federal government he still hopes to take to the High Court, has accused the government of over-stepping the mark in putting the property up for sale.
The John Court property had been occupied by one of Mr Endresz’s associates and former champion athlete, Pat Scammell and his family, up until three weeks ago.
They were given their marching orders by government solicitors who have engaged Albury-based agents, Stanley & Martin, to sell the property.
The title of the property was handed over to the Commonwealth following an order by Justice Richard Refshauge of the ACT Supreme Court for 13 defendants, including members of Endresz family, to pay more than $70 million to the Commonwealth in compensation in 2014.
A subsequent appeal launched by Mr Endresz was dismissed two years later, but the door was left open to continue the fight in the High Court.
Mr Endresz and associates have been involved in court proceedings for 18 years since $8.2 million of misappropriated taxpayers' funds found their way into the bank accounts of his family businesses, including Davis Samuel Corporate Advisory Services.
He has denied blame for the error and is pushing forward with a counter-claim for the $4.3 billion in lost earnings.
Mrs Endresz warned of more legal headaches if the property sold.
“I had to hand over the title with a gun pointed at my head,” she said.
“It will be a fire sale and it is wrong what is happening.
“The case is unfinished, it is still in the courts and is being contested.
“Everything that is going on in background needs to be disclosed.
“This property has a history of baggage and it’s not finished yet.”
Mrs Endresz, who lived in the property with her husband Joszef before down-sizing, said she was planning to attend the auction.
Stanley & Martin agent Scott Wilkie confirmed the Commonwealth held the title to 11 John Court, but declined to comment further.
Mr Endresz confirmed he would be launching his latest bid to enter the High Court with the long-running case next week.
“I will definitely get in there, but it is just taking me a long time,” he said.
“I’ve had to go through the nightmare of exhausting all the different avenues.
“It’s definitely looming but not fast enough unfortunately with where mum is at with the house.”
