ALBURY businessman Allan Endresz is battling to revive a legal battle with the federal government dating back to the mid-1990s in the High Court.

On the same day he was was back in Canberra making another application to the High Court, the federal finance department clarified its position in relation to a North Albury home to be auctioned this weekend which was previously owned by Mr Endresz’s parents.
“In late 2016, the Commonwealth became the lawful registered owner of 11 John Court, North Albury, New South Wales and obtained legal title,” a department spokesperson said.
“A number of defendants to the civil proceedings have sought to appeal the ACT Supreme Court decision and have made four failed applications to the High Court.
“The latest High Court order in October 2017 stated that an appeal to the High Court ‘would enjoy no prospect of success’ and rejected the application for special leave to appeal.
“Consistent with government policy, the property is to be sold using an open and competitive process at market value.”
Dawn Endresz told The Border Mail: “I had to hand over the title with a gun pointed at my head.
“The case is unfinished, it is still in the courts and is being contested.
“Everything that is going on in background needs to be disclosed.”
