After being caught performing the lewd act in front of a woman in broad daylight, with a large number of other people nearby, Joel Gerard Breewel fell down head-first into concrete, cracking his head.

While on the ground, he lit up a smoke before walking down a lane and ending up near Wodonga Catholic College.

Police found him lying on his back near the school with his pants around the ground, rolling around on the ground and trying to resist arrest.

Officers called paramedics and the 28-year-old sobered up in the police cells.

The incident occurred on Wednesday and Brewell fronted the Wodonga Magistrates Court the following day.

Cuts were clearly visible on his head from where he had fallen down.

The court heard Brewell had been “very drunk” during the incident, which occurred after he drank wine.

The lewd act occurred in the car park near Jetts Fitness.

Prosecutor Penny Lawler said it had followed a string of incidents – some of which can’t be reported for legal reasons.

Breewel entered a 7/11 store on Russell Street in Melbourne on November 5 last year and asked for cigarettes.

He became aggressive and asked to have them for free before walking out with a $5 bottle of Coke.

He also stole bourbon and Coke cans from a Melbourne bottle shop on November 25.

Lawyer Mario Vaccaro said his client had a chronic alcohol problem and was living on the streets with his partner.

He was placed on a community corrections order.
