Eighteen-year-old Jason Fox said he “didn’t do that stuff. I was just there to protect my nephew.”
Fox and 43-year-old Kenneth James Fox pleaded guilty in Albury Local Court over an incident that left their victim in grave fear.
The senior Fox – the court was not told of the pair’s family relationship – faced more charges as he assaulted the victim the day before both of them went to the unit.
“I’m very sorry that this has happened,” he told magistrate Rodney Brender.
Kenneth Fox pleaded guilty to assault and two counts of being armed with the intention of committing an indictable offence.
He went to the victim’s Hague Street unit on May 26 about 8pm and knocked on the front door.
The man’s partner opened the door and Fox pushed past her.
The victim saw he was armed with a baseball bat so in fear he fled outside and hid under a car in the backyard.
“Come out you little dog,” Fox called out, “I’m going to kill you.”
Fox crouched to see the man under the car and told him: “Get out of there, come on,” then hit him to the head several times with the bat.
The following day, about 6pm, the victim and two others were sitting in the lounge room of the unit when he heard a knock on the door before the two Foxes yelled out his name. He then heard what he thought to be baseball bats tapping on the front of the house and so became concerned for his safety.
When he went to the window, he saw the Foxes outside holding the bats. They threatened to “smash” him.
Police were called and the pair denied having bats, yet after their arrest a search of their car uncovered two metal baseball bats in the back.
When asked about the bats, the younger Fox replied: “Yeah, we had them.”
Jason Fox pleaded guilty to a single charge of being armed with intent to commit an indictable offence.
Mr Brender ordered the pair undergo pre-sentence reports as he said he wanted to know more about them.
They will be sentenced on August 15.
