Giampietro Francioli allegedly aimed the weapon at the man while inside a car on May 4.
It’s alleged the gun followed the path of the victim as he fled from the vehicle, with two shots fired at the man.
He had been released on bail after the incident but was taken back into custody by Operations Response Unit officers on the main street on May 23.
The Wodonga Magistrates Court on Thursday heard Francioli had been driving a car with his brother and his brother’s partner in passenger seats when they came to police attention.
A search allegedly found 23 rounds of ammunition hidden in a bread bag inside a pillow case.
The pillow case was located between the passenger and driver’s seat.
Defence lawyer Jacob Kantor argued his client – who appeared before court in a dark suit – should be released, given that new facts and circumstances had emerged.
Police opposed bail.
Mr Kantor said investigators had compiled a brief of evidence and questioned the strength of the prosecution case.
A forensic examination of gunshot residue is yet to be undertaken.
The case is set to be examined during a two-day hearing on November 7 and 8.
Mr Watkins said while it would be difficult for Francioli to spend time in custody, there would only be a delay of about six months between the alleged offence and the matter going to hearing.
The magistrate said he had failed to show new facts and circumstances and refused bail.
