Daniel Jacob Rolton was visibly distraught when brought into the dock of Albury Local Court on Tuesday to face charges of destroy or damage property and stalk or intimidate.

The 21-year-old made a bid for bail, but this was then withdrawn to be re-lodged before Wagga Local Court on Wednesday.

A series of eight charges related to the incident in late August in which a man, 41, was allegedly smashed in the head with a metal shifting spanner and a woman pushed to the ground and injured with a knife were also mentioned in court.

Rolton’s co-accused in that matter, Thomas Sands, also 21, made a brief appearance over those allegations via a video link to June jail.

Sands’ matters were adjourned for a further mention next week.

Magistrate Rodney Brender was told that Rolton was someone who would be “extremely vulnerable” if he was continued to be held in custody.

That was because of his intellectual disability, the fact he suffered from attention deficit disorder and was blind in one eye. If refused bail it would be his first stretch behind bars.

The court was told the latest allegations stemmed from an incident that occurred when Rolton attended a wake on Sunday following his grandfather’s funeral.

He was urged by others to have a drink and after initially resisting the pressure, he gave in and had several.

Rolton has no memory of the incident, which was not outlined in court though details were handed to Mr Brender.

Concern was also raised that Rolton has been “hearing voices” and would benefit from an assessment before bail was determined.

Rolton’s charges relating to the alleged incident at the Thurgoona Street unit include aggravated break and enter with intent, special aggravated enter dwelling and commit serious indictable offence and assault occasioning actual bodily harm in company with others.
