Ryan Wayne Kenny, 31, is facing a string of charges over the collision at Brimin on November 2 which killed Amanda Kilmister and her son Harrison, 10.
Police allege Kenny had methamphetamine and amphetamine in his blood after the crash, but questions were raised about the admissibility of the evidence in Wangaratta Magistrates Court on Thursday given the time between the crash and blood test.
Kenny has previously blamed prior positive results for truck driving on meth on painkillers given for a headache, ibuprofen, and medication given to him for a toothache, the court heard.
“No, I don’t do drugs, I guess I’ve only taken tablets for a toothache that the dentist put me on,” he said after an alleged positive on July 31.
His wife, Ashlee Kenny, also told the court he wasn’t a drug user.
“There’s no drugs, alcohol or anything kept at our house,” she told the court, adding she'd never known him to use drugs.
Sergeant Mario Eliades said it must have come as a complete surprise that Kenny had allegedly been caught driving with ice in his system four times.
“Yes,” she replied.
Police continue to chase up tip-offs provided to them, including one relating to drugs made anonymously through Crime Stoppers.
They are reviewing CCTV footage in a bid to determine what breaks Kenny took on the day of the crash.
He had been driving between the Wodonga and Tongala abattoirs, with a witness alleging he drove on the wrong side of the road for 600 metres at one point.
Magistrate Fran Medina said the allegations were “grave” but Kenny had never been in custody before, was not a flight risk, had a stable residence and no history of non-compliance with court orders.
