Ziggy Kennedy has fronted Albury Local Court over his lax attitude, referred by NSW Community Corrections.
His attitude certainly failed to impress magistrate Rodney Brender.
“Can’t be bothered?” he asked.
“That’s what it appears.”
Mr Brender suggested Kennedy was putting his liberty at risk over his non-compliance.
“Community service is an alternative to jail, isn’t it?”
Mr Brender told defence solicitor Bronte Winn that the only alternative to sentence was either something less onerous or, as was likely, more.
To allow an assessment to be carried out on the sentencing options available to the court, he adjourned the matter for a day.
The case was then further adjourned to Tuesday
Kennedy, 22, was originally sentenced in early August to 150 hours of unpaid work as part of a community service order for assault.
Initially, Kennedy – who threw a head punch in the fight – was reluctant to be assessed for the order then relented only when he faced jail if he didn’t.
Kennedy had pleaded guilty to assault over the street fight.
He had a previous conviction for assault actual bodily harm.
Kennedy’s victim had not long finished work, about 4am, when the melee started, with a co-offender throwing punches before being dragged away by a man who worked at Sweethearts.
This man called police and then saw the other man had not calmed down, so grabbed him again.
Soon after, the victim saw Kennedy approach him from the side.
Kennedy then raised his right fist and swung at the victim, hitting in to the left temple area.
Police arrived and gave chase to Kennedy and a co-accused as they ran across a car park.
When they caught Kennedy he abused them.
He told police that he had run because “I don’t trust yas.”
