Lee Botting was commenting after a motion to spill the committee of management was lost on Monday night.
His deal to run the RSL kitchen was terminated in January, with sub-branch president Kevyn Williams citing contract breaches.
Mr Botting said the motion’s defeat gave him no hope of resuming at the club.
“I’m just going them hard because there is no negotiation with regards to my return to the RSL,” he said.
“If a new committee got in it was asked ‘would I be interested and prepared to go back if the terms were in my favour?’ and ‘I said ‘yes, of course’.
“There would still be some damages for loss of income, but minimal to what I’m going to go for now.”
Mr Botting said his lawyer had served a letter outlining his plan to sue for breach of contract at the end of January and there had been no reply.
“We’ll apply to the court for a date if we don’t receive a response in X amount of time,” he said.
The letter to the sub-branch does not specify an overall amount of damages sought, but outlines weekly losses and money Mr Botting says he is owed in relation to stock.
Mr Williams was asked by The Border Mail when the sub-branch would reply to Mr Botting’s action.
“For legal reasons I’m not saying anything,” Mr Williams said.
Mr Botting said he had not worked since leaving the RSL and would now chase other catering options.
