The 15-month-old Staffordshire Terrier named Marley had been taken from Zak Cheep last May amid concerns about the way he had been treating it.
Despite his anger, Cheep has not been returning calls to the RSPCA.
The welfare group’s eastern region team leader Guy Gorman successfully applied for a disposal order in the Wodonga Magistrates Court on Wednesday.
The order, which was made under the Prevention of Cruelty to Animals Act, means the dog will be able to be re-homed.
