THE works still to be completed at Lavington Sportsground by Depan Group at the time of its liquidation in early March could create another cost over-run on the project for Albury Council.

The council's general manager Frank Zaknich has confirmed sub-contractors who worked at Lavington before Depan's financial collapse have been engaged to complete outstanding works on stage one of the overall project now worth close to $20 million.
"Following the Depan liquidation, council has taken over the outstanding works, which are progressing well," Mr Zaknich said.
"The new oval is complete and will be available for use over the coming months.
"Other items such as electrical works, plumbing and irrigation have also been completed.
"Outstanding works such as the cricket practice areas, fencing and landscaping are under way or programmed to commence shortly."
The sub-contractors are being paid by council from funds it held in reserve.
The amount retained by council has been deemed as confidential and council can't confirm whether it will cover the full cost of outstanding works.
Variations to date total $5.5 million and relate to the discovery of unsuitable soil on the new sportsfield Depan was engaged to construct and higher than expected costs on the next stages of work Hansen Yuncken will begin work on soon.
Depan Group was awarded a $2.7 million contract for the Lavington works in June 2017 with the council report presented to councillors including the revelations it was a "relatively new company of less than two years old" and assessing its financial capacity to complete a project of this scale was "challenging".
Depan was the cheapest option and $500,000 under the next lowest tenderer, Joss Construction.
Cr Darren Cameron said a push for council to cover payments owed by Depan at the time of its collapse required a measured approach.
"I'm inclined to help people who are suffering hardship as a result of work they have done on council projects," he said.
"But I want to see council have a settled policy on such situations so everyone knows what the ground rules are.
"It's important we get a proper report with the names of all the creditors and what they are owed.
"Then we examine their individual situations and see if we can help them."
The liquidator will release a revised creditor listing tomorrow which will guide council's next step.
It was presented with more legal advice on Monday.
