Tom McLean's solicitor tried unsuccessfully on Wednesday to have a jail term imposed that comprised entirely of time already served.
Even if magistrate Rodney Brender had taken that course of action, two Wodonga detectives were in court ready to proceed with an extradition application regarding outstanding matters in Victoria.
McLean, 25, appeared in Albury Local Court on Wednesday for sentence via a video link to Junee jail.
Mr Brender decided the threshold for custody had been crossed.

But he ruled that McLean could possibly serve that by way of seven months' home detention.
That followed an earlier submission by defence solicitor Emma Harrison that McLean could live at his girlfriend's Howlong home.
Ms Harrison said McLean had been promised work in the family business of his girlfriend.

Detectives went to the Hovell Tree Inn about 12.30pm that day after receiving information there was cannabis in the room, which had been booked by McLean and his girlfriend for two nights.
Police found 27 MDMA, or ecstasy, pills weighing 6.8 grams and with an estimated street value of between $400 and $500 inside a bedside drawer.
One gram of cannabis was on the bed.
