The 40-year-old, who The Border Mail has chosen not to name in order to protect the identity of his victim, appeared in Wodonga Magistrates Court this week to plead guilty to using a carriage service for cause offence.

The court heard the woman had not given her consent to being filmed when the pair slept together, after the man offered to give her a lift to her North East home in his car.

They had broken up two months earlier and also have a child together.

While the offence occurred in November 2017, there was a delay in reporting what occurred to police.

Other police investigations around the man's behaviour with his ex-girlfriend did not lead to charges - meaning the case was only brought to court this week.

"He acknowledges his behaviour was stupid and hurtful, he is sorry," the man's lawyer said.

"He says it will never happen again."

Magistrate Ian Watkins said modern technology allowed for the taking of intimate photos and that had to be respected.

"You didn't do that, you went beyond that. Your behaviour was designed to cause maximum humiliation for your former partner," he said.

"The trust was abused in the most appalling manner."

He said if the sexually explicit image had been shared publicly online, rather than just sent to one person, he would have sent the man to jail.

The court heard the man had a limited criminal history.

Mr Watkins handed down the $1500 fine with conviction.
