Dean Rees was forced to front Wangaratta Magistrates Court on Wednesday after receiving a third and final notice in the mail to pay an outstanding fine.
He told the court he had not received the first two letters and was not driving the car, which was registered to him, when it was caught by the traffic camera in Melbourne in August.
"I have kids that are very inquisitive of the mail, but they assured me that they hadn't taken it," he said.
"I wasn't the driver at the time."
Cr Rees was granted an extension of 28 days so he could nominate the correct driver to pay the fine.
