A magistrate has expressed his disbelief at a disqualified driver who twice got behind the wheel again after being given a term in custody.

Ricky Cusack was handed "an incredible outcome" of an intensive corrections order in November, magistrate Richard Funston said.
"And with (his partner's) baby on the way he goes out and drives again, then does it again on January 26," he said.

Defence lawyer Camille McKay said Cusack had not committed any driving offences in Victoria since 2009 and then had this very recent spate of matters in NSW.
Ms McKay said there were also no aggravating factors attached to Cusack's driving, such as speeding or any other dangerous behaviour, when he was detected by police.
Mr Funston failed to agree on that point.
"But there was the aggravating factor of him being on an ICO," he said.
Mr Funston said Cusack had showed "no remorse" and was "just turning his thumb up to the court".
"Your hands are tied, Ms McKay, your hands are tied," he said, referring to sentencing options for Cusack.
Mr Funston said Cusack was fortunate to not have received full-time custody in November.
But this time he was sentenced to 12 months' jail, with a non-parole period of nine months.
That will make him eligible for release on October 25.
Cusack, who had remained quiet throughout his matter, became agitated when he initially thought he had been sentenced to a fixed term of 12 terms.
He calmed down again though when the non-parole period was set.
The silver-haired and balding Cusack, 39, of Garoogong Road, Springdale Heights, pleaded guilty to two charges each of a second offence of disqualified driving and using an unregistered vehicle.
The court was told how Cusack was seen driving on Garoogong Road on December 18.
He then pulled his unregistered car into a driveway.
Police pulled in behind him as Cusack got out of the driver's seat.
They interviewed him and he admitted he was a disqualified driver.
The second incident, on January 26, took place in Breen Street, Lavington.
