Unemployed Wangaratta man Joel Paul Sellar has been languishing in custody over the incident since February 6.

And there he will remain until May 6 after Albury Local Court magistrate Miranda Moody jailed him for three months.

Defence lawyer Sascha McCorriston said Sellar, 39, had little recollection of the assaults.

That was because he most likely suffered a concussion after being attacked himself earlier that same evening.

But that curried no favours with Ms Moody, who said the incident was "a great deal more serious" than a usual common assault.

"He's got a terrible record ... I think the threshold (for jail) has been crossed," she said.

"Spitting blood; it's not the same as saliva."

Sellar, appearing via a video link to Junee jail, apologised, in addition to a letter of apology sent to the victims through his lawyer.

"I'm a bit embarrassed about it," he said.

Sellar earlier had pleaded guilty to two charges of common assault.

The court was told that Sellar had an "extensive" criminal history in Victoria, with six warrants out for his arrest in that state and one in Queensland.

The two victims, aged 18, and Sellar were all at the Sweethearts pizza shop on February 7 when the incident occurred just after 1am.

The victims were standing outside the entrance.

"The accused had been in a previous altercation with another male and as a result had a split lip, which was bleeding moderately," police said.

"The accused was yelling at a group of people across the road when (one of the victims) said to the accused: 'Just go home, just leave'."

When the first victim called him out on replying with "you dumb f ... ing sluts" he said "sorry" then resumed yelling at the group across the road.

She again told him to leave, for which Sellar "spat a mouthful of blood on the victims, landing on (the first teenager's) face and leg as well as (the second teenager's) lower body and leg".
