Albury magistrate Richard Funston told Brayden Bosio he could have easily been heading into custody.
"If you had prior criminal history for acts of violence I'd be locking you up today," Mr Funston said.
IN OTHER NEWS:
Bosio was involved in a fight in the foyer of the Mulwala Water Ski Club on December 28 just before midnight when Mulwala police moved in.
One officer was forced to use capsicum spray to try to subdue them, at which point Bosio shoved him then punched him to the side of the face.
The 29-year-old carpenter traveled from Melbourne to be sentenced in Albury Local Court on charges of assault police and offensive behaviour.
He was also on a warrant for driving while unlicensed.
"That (police assault) charge is a very serious charge, it has a penalty of five years' (jail)," Mr Funston said.
He did not accept Bosio's excuse that he believed his suspension period had ended.
"He knew what he was doing. He's had serious penalties for driving matters before (in Victoria)."
Bosio was in Mulwala for a fishing competition when he got into the fight with another patron in the foyer of the club at 11.50pm.
After the officer was forced to use his capsicum spray, "the accused then hit (him)" with a punch to the left cheek.
On the unlicensed driving charge, police said Bosio - again, in town for a fishing competition and towing a boat trailer - was pulled over on February 17 at 6.40am for a breath test.
A check revealed his Victorian licence has been suspended.
Bosio was put on a 12-month community corrections order, convicted and fined $900 and given a three-month licence ban.
