Trinity John Carter, 41, was successful in his application before Wodonga Magistrate's Court this week.
IN OTHER NEWS:
The court was told Carter had spent well over 200 days in custody over the incident from August 31 last year.
Strict bail conditions were agreed to between Carter's defence and the Crown.
The bail conditions imposed on Carter by magistrate Peter Dunn included reporting to police three times a week, observing a 9pm to 6am daily curfew and not contacting his co-accused, Felicity Meloury, or any witnesses in the case.
Carter has been accused of aiding Meloury in setting room four at the Warrina Motor Inn by the act of handing her a cigarette lighter then used to set a mattress alight.
Meloury was set to plead guilty but the court has now been told that this will proceed to a hearing.
Carter's matter was adjourned to a later date. He is fighting the allegation.
