His son, two-year-old Lincoln Browne, tragically died in the incident at the Moss Road property in Barnawartha North.
Police are alleging Browne, 31, was using the vehicle and his son was a passenger.
Another family member was injured during the incident.

The 31-year-old started crying when speaking about the case with magistrate Andrew McKenna.
