Tom Vonarx was arrested on Friday, just hours after being released from a mental health service in Wangaratta.

It's alleged he went to the BP petrol station on Greta Road in Wangaratta about 11am and was told to leave, before telling a worker "I'm going to cut your throat".

He allegedly had a brick hammer, similar to a pick axe, in a bag.

It followed a similar incident which allegedly occurred at Wangaratta APCO in the early hours of September 4, which witnesses said involved a pick axe.

He allegedly returned the following day and refused to leave before saying "if you call the police, I'm going to kill you".

He allegedly jumped the counter in a bid to prevent police being called.

Vonarx was on bail for an alleged burglary with police raising concerns in court on Monday that he was unacceptable for release.

Officers believe Vonarx drinks heavily and has been using methamphetamine.

He asked police bizarre questions following his arrest, including why refugees were protected and not Anzacs.

While he has been diagnosed with schizophrenia, mental health workers believe his issues are behavioural problems, and not mental health related.

Lawyer Geoff Clancy applied for bail on Monday and said it could be a condition of release that he goes in for treatment.

"We have these hospitals here for people who have serious mental health issues," he said.

"Mr Vonarx certainly does have them."

He was remanded in custody and will return to court on Wednesday.
