Troy William Clark assaulted the woman, Albury Local Court has heard, after abusing her over the whereabout of cigarettes to mix with cannabis for smoking.

The 49-year-old knew he was supposed to attend court to answer the charges of common assault and damage or destroy property but chose not to attend.

Instead, he wrote to the court asking for a three-month adjournment of his case.

It was not the first time he was seeking more time over the matter.

But magistrate Miranda Moody rejected the request, pointing out the existence of warrants out of his arrest for other charges.

"And so it's no surprise he's not at court today," Ms Moody said.

She convicted Clark and issued a section 25 warrant for his arrest.

The court was told that Clark and his partner had been in a relationship for three years and didn't have any children together.

They were inside their lounge room on October 11 about 6am when Clark began abusing the woman, angry about the missing cigarettes.

Police said that as a result of the argument, Clark picked up a wooden pole in the same room and approached the victim.

"The accused used the pole to pin the victim down to the ground. While the victim was pinned to the ground, the accused put his right foot on the victim's head and neck."

This terrified the woman.

A few hours later, about 10.30am, Clark again approached the victim and began another argument.

She'd had enough of his behaviour, so collected some of her belongings and headed off to her sister's home, which was just across the road in Bralgon Street.

Soon after Clark also left, walking to the sister's house.

He spoke to the victim, asking her if she was going to return home.

"No," she replied.

Clark was holding a figurine ship owned by the victim as they talked.

He raised this above his head then smashed it to the ground.
