It follows a brief mention of the application - from a fellow candidate at the recent council elections, Ross Hamilton - in Albury Local Court on Tuesday morning.

Lawyer Mark Cronin asked magistrate Richard Funston for an adjournment of the interim order to January 17, which he granted.
That is when a criminal charge laid against Mr van de Ven, of stalking or intimidation, will be first mentioned.
Police charged the former mayor in the wake of an incident where it has been alleged he threatened to punch Mr Hamilton when they were outside the election pre-polling site at the former tax office in Smollett Street, Albury a week ago.
Mr van de Ven lost his position on Albury Council at the weekend after securing less than 5 per cent of the vote.
At the time, he declined to comment on being charged by police.
