Hart, 27, appeared in Albury Local Court through a video link from Long Bay jail and solicitor Jason Hanke represented him during his brief appearance.
Director of Public Prosecutions representative Andrew Hanshaw said a partial police brief of evidence had been served, but further time was being sought for extra material.
Hart has been charged with the murder of Lavington man Luke Hargrave, 32, between 10.50pm on October 29 and 4.30am the next day.
There was an additional charge of malicious damage filed in court yesterday.
It was alleged Hart intentionally or recklessly damaged the rear seat of a Corrective Services vehicle after his arrest and remanding in custody.
Magistrate Tony Murray was provided with a statement from the officer in charge of the case, Det-Sen-Constable Nathan Hogg, outlining what had happened with the preparation of evidence.
Mr Murray was told an extensive police brief with more than 250 items had already been served.
But a number of important items were outstanding, including a pathologist’s report and other expert statements.
The expert evidence related to two ballistics reports and another report on the examination of a burnt out car found near Gerogery West.
Mr Hargrave was shot in the face in his home in Vickers Road.
Hart, formerly of Jindera, was arrested in a Gerogery street about 6.30am on October 30.
It followed the discovery of a burnt out Holden utility near Gerogery West by a woman returning home from work.
Police said the gun allegedly used in the shooting was found inside the burnt out vehicle.
Mr Murray ordered the preparation of additional evidence be served on the Legal Aid Commission in Sydney by March 17.
Hart’s charges were adjourned for further mention in court on March 31.
