On the first occasion she was away but she was inside, late at night, the second time.
And Albury Local Court was told police were awaiting the results of a forensic examination of DNA samples to determine whether Bradley Luke Collins was responsible for other offences at the address.
Magistrate Tony Murray indicated his frustration that he could only impose fines on the two counts of enter enclosed lands without lawful excuse, to which Collins pleaded guilty.
“She’s home alone, it’s 10 o’ clock at night.
“This is one offence that in my view the penalty is not sufficient.”
Mr Murray also pointed out how Collins’ excuse in court for his offending differed from the reasoning he gave to police, as outlined in facts handed to the court.
Collins’ solicitor said his client was “very apologetic” for any upset that was caused – having earlier claimed that he simply wanted to inspect the house given it was for sale – and that he was unaware anyone was home.
But police said the incident had traumatised the woman who owned the house as she “feels intimidated and feared for her personal safety”.
Police said Collins, 32, walked three kilometres from his Padman Drive unit to the house on May 27 about 7pm.
He knocked on the front door “a number of times”, but when there was no response he entered a back courtyard, knocking on a glass door before smoking several cigarettes.
When police arrived he told them “this is my house”.
The second incident was on May 30 about 10.40pm when the victim was home inside.
Collins entered the courtyard and banged loudly on the sliding glass door as the victim watched.
Collins gave three different excuses to police in a later interview: first he was seeing a man called “Bronzeman” for legal advice, that he was there to see a friend and thirdly, because he wanted to buy the house.
Collins was convicted and fined $450 on each count.
