The words should have come from the mouth of a loving and caring father and husband.
Instead, they came from a mouth that had spat on the children’s mother and used foul language in front of them.
Speaking briefly about the youngsters was the only thing the 23-year-old said while being sentenced in Wagga Local Court on Monday after pleading guilty to common assault, intimidation and contravening a domestic violence order.
According to facts tendered to magistrate Michael Crompton, the couple was in the lounge room of their Kooringal home about 11.30am on June 21 when the eldest child began crying.
The man said to to his partner: “ Get the … up and get your kid.”
“The victim stood up to go and get the child and the accused gathered a large amount of saliva in his mouth before spitting it onto the left-hand side of the victim’s face,” the police facts said.
The victim told the man to leave the house and he responded by saying: “keep going and I’ll hit you”.
The court heard that at the time of the degrading assault, the man was on two good behaviour bonds he signed less than three months before after being convicted of assaulting and intimidating the same woman.
Mr Cromtpon said there was no alternative to full-time jail for the man.
He said spitting on the woman was an act of violence and an act of gross disrespect.
“Domestic violence of this kind is to be denounced quite clearly by the courts and is not to be tolerated,” Mr Crompton said.
The man was given a four-month fixed jail term for contravening the domestic violence order and concurrent three-month terms for the assault and intimidation, all backdated to when he went into custody on June 21.
The two good behaviour bonds were revoked and the man re-sentenced to concurrent three-month jail terms starting from Monday.
Meanwhile, a Turvey Park man who pushed his partner of 10 years in the face with an open palm and then grabbed their daughter by the arm, causing her to scream out in pain, has been ordered to perform 90 hours of community service after pleading guilty to two counts of common assault.
The domestic assaults stemmed from an argument about the man’s plans to drink alcohol at a party.
