The council has confirmed negotiations were still under way with the NSW Department of Education for access to an outdoor basketball court within the school grounds alongside the Bungambrawatha Trail.
The aim is to have the approval in place by June 30.
It's estimated to cost nearly $20,000 to bring the court at Albury High School up to an acceptable level for use by the community with the council also prepared to cover security costs for opening and closing gates into the court.
The single court will be located less than a kilometre from the Albury CBD, but won't have access to toilets or drinking water.
The NSW Department of Education could cease any licence agreement at short notice, according to council documents.
Creation of outdoor basketball courts were floated during last year's council election campaign with two re-elected councillors, mayor Kevin Mack and Darren Cameron, and former deputy mayor Ross Jackson backing a petition launched by basketball identity, Chris Maginnity.
It was originally proposed a three-court outdoor facility be created, but it was agreed two courts in a central location would be sufficient.
The council has included $31,000 in its 2017-18 draft budget for detailed design works and a further $250,000 has been proposed the following financial year for construction.
The former South Albury Tennis Club site within the Waites Park sporting complex has emerged as the preferred location for the permanent courts. It's already home to Albury's AFL Auskick centre and volleyball with the site considered the most suitable nearest central Albury.
The council has also committed to upgrade the court in Haydon Court in East Albury. Part courts available for community use are also situated in Lavington, North Albury, Thurgoona, West Albury and within the skate park near J.C. King Park.
