Lisa Turner, 33 and her son Jack Wallace, 4, were killed after a BP petrol tanker detached from a truck at Staghorn Flat in August 2014. 

The petrol tanker crushed their Holden Captiva.

The tragedy left Damien Wallace without his wife and son.

Peta Cox, 67, also died in the smash when her Mazda was hit. 

The tragedy occurred on the Wodonga-Yackandandah Road, where moving roadside tributes still sit for the victims.

All three had died at the scene.

An extensive police investigation did not find enough evidence to lay criminal charges, which had upset family members. 

Police had stressed the truck driver was not at fault. 

The investigation moved from Victoria Police to WorkSafe. 

The government safety agency will file charges in the Wodonga Magistrates Court on Tuesday.

The charge of failing to ensure person not exposed to risk will be laid against Heavy Mechanics Pty Ltd, which has a workshop in Kane Road. 

Tuesday’s filing hearing is likely to be brief and set out the timetable for future court appearances. 

Peter Wallace, who lost his grandson Jack and daughter-in-law Lisa, spoke to The Border Mail last year about the impact of the incident. 

“You think about it every day – it never goes away,” he said last July. 

“It doesn’t really get that much easier. The best outcome would be to find an answer to what’s happened and what can be done about it.”
