Tamas Istvan Beregszaszi pleaded guilty in Albury Local Court to the charges and magistrate Tony Murray imposed a seven-month jail term, with a minimum of four months to serve.
But Beregszaszi, 26, of Bilba Street, lodged a severity appeal, which is listed for the District Court sittings starting on August 11.
His bail conditions prevent him from occupying the driver’s seat of any vehicle and he has to report three times weekly to police.
Mr Murray banned Beregszaszi from driving for four years from July 8 this year.
He was driving a gold Calais with Victorian registration when stopped by police in Atkins Street, South Albury, about 1.04am on April 5.
When asked to produce a licence, he said: “I don’t have it. I have a proof of age card that has the same number.”
He admitted consuming his last drink of alcohol about 30 minutes earlier.
Beregszaszi had drunk four cans of Jack Daniels at a friend’s place from 9.30pm and two pints of heavy beer at a nightclub.
A breath analysis gave a reading of 0.087, his licence was suspended and he declined the opp-ortunity for a doctor to take a blood sample.
A check by police showed his Queensland licence expired on March 3, 2012, but there was a cancellation date of March 14 this year.
An officer contacted the Queensland police communication centre to clarify the status of his licence.
It showed the licence was disqualified from March 14 this year.
Beregszaszi also received a penalty notice for using an unregistered car, with the registration expiring on November 22 last year.
