The case involving Benjamin Dinan, 26, was due to be heard before the court in Albury on Friday.
But it was unable to proceed when a Legal Aid solicitor informed the court that Dinan was no longer eligible for assistance.
Dinan was asked whether he wished to still proceed through seeking representation from a private solicitor.
“I think I can,” he said.
Dinan’s case was then adjourned to the court on November 26.
Dinan was told he would had to otherwise wait until the February sittings if he did not instruct a private solicitor within the next week or so.
Albury Local Court heard on October 1 that Dinan was so drunk when he punched and slapped the two men in July that had no recollection of the incident.
Dinan also had no explanation for what caused the incident.
He had only recently been released from prison on parole when he attended the Northside Hotel with his father on July 18.
The two victims had been playing pool at the venue and Dinan joined in.
His father had been talking to one of the victims when Dinan punched one of the men.
He walked around the pool table and slapped the second man, who has cerebral palsy, with the back of his hand.
Magistrate Tony Murray jailed Dinan for 12 months, with him eligible for parole after six months.
