Daniel Laurence Dybing was standing guard outside a West Albury house at the time as a mate went inside to retrieve a mobile phone.
He and his accomplice believed a man inside the Hibiscus Circuit had the phone recently bought by Dybing’s girlfriend of six years.
Police said that when a woman outside the house began to phone Triple-0 on her phone, Dybing “threatens her with violence by lifting up his shirt and indicating towards a firearm” that he didn’t have.
It wasn’t long before Dybing and the other man were arrested by police late on the night of January 16.
But Dybing’s offending didn’t end there, Albury Local Court was told on Monday.
Dybing expressed concerns to the investigating officer about what he said.
Dybing, 45, told the officer he had not signed the three police compact discs containing his interview.
When the officer went to get a marker pen, Dybing tried to grab the CDs.
He eventually grabbed the discs and ran to the other side of the room, breaking each – meaning the contents of his interview were lost forever.
Dybing, of Pemberton Street, pleaded guilty to aggravated break and enter and commit a serious indictable offence in company and tamper with evidence with intent to mislead a judicial tribunal.
The court heard Dybing and his accomplice formed their plan when drinking at a bar earlier that night.
Dybing’s partner collected the men and drove them to the West Albury house, where the accomplice forced the front door.
Dybing will be sentenced at the District Court sittings beginning on January 11.
