The member for Indi has objected to a bill stripping citizenship from dual national terror suspects on the basis it is retrospective.
Senator Leyonhjelm said Ms McGowan's concern was well founded.
“When governments start passing criminal laws retrospectively, we might all be engaging in criminal behaviour without knowing it,” Senator Leyonhjelm said.
He is also opposed to giving power to the executive which should lie with courts.
“We should not give ministers the power to punish people; this belongs with the courts,” Senator Leyonhjelm said.
