The 35-year-old’s latest spell comes as a result of him walking out of an East Albury store with jackets and a bag.
He also broke into the Harris Scarfe department store in central Albury in the early morning, pinching a staff member’s security swipe card.
“These are serious offences,” magistrate Rodney Brender told Togher, who appeared in Albury Local Court this week via a video link to Junee jail.
Mr Brender then went on to list years in which Togher had been given jail terms.
The first was in 2006, followed by 2008, 2009, 2012, 2014 (he served two years and five months) and 2017.
Mr Brender told Togher that a pre-sentence report indicated that “your family is despondent about your relapse back into drugs”.
Defence solicitor David Rofe asked for a lengthy parole period or the imposition of a bond for when Togher left jail so he could reap the rehabilitative benefits of supervision.
Togher pleaded guilty to two counts of shoplifting and one of break and enter with intent to steal.
His criminal history includes 27 charges across six cases in NSW mainly for larceny, stealing from cars and break and enter and 82 offences in Victoria and Queensland.
The court was told how Togher went to the Anaconda adventure store in East Albury early on the afternoon of April 30, grabbing a $200 duffle bag and two jackets valued at $420.
He walked straight out of the store, prompting the manager to challenge him.
“Are you going to give the bag back?” he asked.
When Togher said he wouldn’t, the manager suggested he “smile” for the in-store security cameras.
“I don’t give a f …,” Togher replied.
Police said Togher was seen riding his bike in Dean Street, near AMP Lane, on May 1 about 3.15am.
About 3.20am, security cameras at Harris Scarfe showed him inside stealing the swipe card.
He was arrested 12 hours later when police pulled over a ute in which he was a passenger.
Toghe was found with two sealed boxes containing headphones, one of the boxes having been stolen from Office Works in Albury days earlier.
Togher was sentenced to 12 months’ jail with a non-parole period of nine, making him eligible for release on January 31.
