Ex-husband Tony Chetcuti lodged a writ in the Supreme Court this week seeking damages, claiming killer Michael Cardamone was not properly supervised while on parole.
Lawyer John Suta told 3AW Radio there was a precedent for victims of horrendous crimes to sue the state.
"He was on parole, basically left to his own devices, unsupervised," he said.
"There's many victims of horrendous crimes in the past that have sued the state of Victoria on the same basis, but this is probably one of the most brutal, horrific murders that the state of Victoria's ever seen."
