Franks allegedly returned a reading of .160 and was charged with high-range drink-driving and negligent driving causing death.
Albury Local Court on Monday heard Franks was now facing an additional and more serious count of dangerous driving causing death while driving under the influence.

Lawyer Mark Cronin said the matter would go to trial.
An application was made for the Howlong man's licence to be returned.
He was disqualified when first charged in December.
The court heard the disqualification could remain in place until the end of a trial.
Mr Cronin said his client could therefore serve a lengthier ban than usual.
Magistrate Rodney Brender adjourned the application and criminal matters to July 23.
