That was withdrawn on Wednesday and replaced with a charge of manslaughter.
The downgrading of the charge laid against Greg Trimmings was revealed by Director of Public Prosecutions representative Aaron Thomas in Albury Local Court.
Consideration was being made on Wednesday of a possible bail application by Trimmings, a step that Mr Thomas said the Crown would oppose.

Trimmings has been refused bail since the woman's death in April last year from head injuries allegedly inflicted in their Olive Street unit.
Negotiations between the defence and the DPP have been ongoing.
The couple moved to Albury from South Australia just months before her death.
