A primary school employee who tripped and fell on the footpath while walking pupils from the bus stop to school is suing Wangaratta Council for $150,000 in damages.

A writ filed in the County Court has outlined what the woman says occurred on November 2, 2017.
As part of her duties, she was conveying school children from the bus stop to the nearby school where she worked.
"The worker tripped on a defect in the footpath and fell to the ground," the writ stated.
"The accident was caused as a result of the negligence of the defendant, its servants or agents."
Civil court proceedings were launched in February this year with the Victorian Workcover Authority listed in documents as the plaintiff in the case, on behalf of the school employee.

It stated the council's "negligence" included a failure "to have an adequate system in place whereby the state of the footpath was inspected" and to have a system where "defects in the footpath were promptly repaired".
There was no warning about any issues with the footpath.
The woman has claimed she suffered a head injury, post-concussion syndrome, pain and shock, and adjustment disorder. She initially made a claim for compensation on November 24, 2017.
The amount of $150,203.56 sought was mostly made up of $98,313.84 in "weekly benefits" plus other costs including $3,014 on hospital care, $5,190 for the doctor, $4,882 for allied health providers and $1,722 spent on occupational rehabilitation.
The case is yet to be heard in court.
Wangaratta Council was contacted by The Border Mail, but declined to comment.
