A lawyer for Wesley Wayne Kennedy has told Albury Local Court that an application would be put before the court later this month.

Kennedy would then pursue his next course of action over the charges, having already failed to front court for sentencing.

While magistrate Richard Funston agreed to the adjournment request from defence lawyer Sian O'Shaughnessy, he also made clear his concern at possibly longer-than-needed delays in the case.

"I'm not entirely happy with the way this is unfolding," Mr Funston said.

"On June 22 you get to possibly argue a section 4 (application), then if successful, go for a hearing date, possibly.

"(This is) no criticism of you Ms O'Shaughnessy, I know you're working very hard.

"(But) the courts have got a huge amount of working going on in the next three or four months."

Kennedy was to have been sentenced in late April on charges of possess an unauthorised pistol, possess an unregistered pistol and not keep a firearm safely.

He appeared in court this week, having been granted bail after his arrest.

The court heard previously that the home-made, .22-calibre pistol was inside a plastic toy casing.
