A Killara metal recycling plant's owner is contesting the rejection of an amended planning permit for its operation by Wodonga Council.

Immix relocated to the former Wodonga saleyards site two years ago with nearby residents of the Riverside estate raising regular complaints.
The planning permit amendment was refused at a staff level of Wodonga Council after an objection was received from the Environment Protection Authority, citing it didn't meet the objectives of the city's planning scheme to an adequate standard.
The council also confirmed there had been a "number of community objections" with residents revealing in May this year that their biggest complaint was noise.

But, Immix owner Jim Suggatte will appeal the council decision with a date set for a hearing at the Victorian Civil and Administrative Tribunal next year.
"We rejected it on the grounds of air, noise and traffic pollution and as far as we are concerned nothing has changed," Killara resident Robert Fleming said.
"Immix has appealed the decision while we are in the middle of the COVID-19 virus pandemic, probably thinking we would be less worried about it than about the virus."
The amended planning permit proposed operation and layout changes including removing any restriction on the number of truck movements between 7am to 10pm but maintain a restriction on truck movements between 10pm and 7am.
Also, trucks accessing the site between 10pm and 7am would be required to travel via the Kiewa Valley Highway, away from the Riverside estate.
Stock-piling changes were also proposed.
